Last winter, the fence between our back garden and our nextdoor neighbours garden fell down. It was pretty old and falling to bits, so last summer our neighbour actually took the broken and fallen bits away and tidied the mess. Now, however she is refusing to put a new fence up in its place. There is no dispute that it is her fence to replace, she just says she has more important things to worry about than spending money on a new fence. We have 2 young children, and this situation means they cannot play in the garden without constant supervision.
Is she legally required to replace the fence, or do we just have to wait until she can be bothered to do something about it. We have asked her on more than one occasion to do something, to no avail.

Best to ask the CAB, although to be honest if she cannot afford it, and she has a limited income tough.

If you are worried about the kids and can afford it why not offer to fix it for her or put another fence up your side.

Remember what is pocket money to you could be a months bread and butter for her.

She can afford it - she's an accountant!! She is just being awkward. Anyway, acting on your advice (sort of), we went to the local garden centre and bought half a dozen leylandii for about £30. We left them out in plain view and dug over the ground where the fence is missing. Funny thing - she is getting a man in to do the fence in the next two weeks!!!! Amazing - the power of the leylandii. Best £30 ever spent, although not sure what to do with them now??!! Laughing
