Hello all,
Just wanted to find out if my Aunt can do anything regarding the following problem.
My Aunt has been living at the same address with her parents for over 36 years. Her father died in 1996 and her mother took over tennancy, sadly her mother passes away just a couple of months ago and she applied to the council to take over the tennancy. She just received a letter saying no and that she must leave the property in 4 weeks!!!
The property is a two bed one reception terraced council house and as I said my Aunt has lived there for 36 years. She does NOT want to move, where does she stand legally?
Please offer any advice as she is at her wits end.

this is probably too late but when i moved into my first house, which was council, the missives stated that the house could transfer once i.e to a kid but then not to their kids. If I were you I would try to say that the original tenancy was joint, if you argue the point enough that they might think it was a mistake on their part during the original housing application you might get off ok. if not blow it up into a scandal and threaten the council with the papers, that usually gets them moving.
