My neighbours fence has been repaired so often it is more nails than fence. In yesterdays winds a 6ft square panel was swinging like a gate against the side of my car causing hundreds of pounds of damage to paintwork. The property is council owned but the fence is not council erected so they say it isn't thier responsibility.
I have reported the fence on two occasions to the council as a dangerous structure which borders a public highway. When I moved my car yesterday, the panel flew 7 feet accross the road, narrowly missing my wife and a neighbours car on the opposite side of the close.
Who is responsible? And who pays for damage to my car?
