my neighbour and i share drainage in my garden (ceptic tank) we have a deed that says he must pay me on demand for the charges eg emptying electricity. it says that he must pay in one month from the demand by me. he agrees to the emptying in writing as i inform him before and don't action the emptying until he has agreed in writing (yes he is a *****?). what he then does is give me a check on the very last day the monies are due. so to the question; can i reasonably expect him to give me four clear working days for the check to clear as banks and everyone else does ? if so and he does the same again ,can i then hold him in breach of contract and withdraw his rights of drainage over my land (i will of course remind him of the four day to clear for checks when i send the demand).
is it then easy to withdraw his rights , just like that ?
any advice would be gratefuly recieved
