My 16 (nearly 17) resides in Devon with mum, step common law husband and 5 year old sister. She is in Full time education starting college next week. For years she has said that whenshe gets to 16 she wants to move in with me.
I live inLondon with my wife and three step children. We are very happy for my daughter to move up to us in London an continue her education here.
My daughter has asked her mum if this is ok and her mother has said no.
What are the legal right of a 16 year old in the this request?
Do I have to apply to court for a residency order? Can my daughter apply to the court?
I have my cout papers from the divorce will it state in there if the residency order originally issued was granted till my daughter was outof full time educaton?

| I'm not a legal expert, but my close friend has a 13 year old daughter who is moving in with him very shortly as she no longer wishes to live with her mother. Apparently she has now the legal (?) right to say where she wants to live at that age, but I'm not certain whether it is being done with or without the mothers consent which i suspect is the crucial bit. i would certainly pay a consultation fee with a solicitor to find out the score. |
