my sister in law suddenly died. on contacting her lawyer she informed us that her will had not been updated as her husband had died 5 years ago and she had left everything to him. She informs us that she has therfore died intestate.
The lawyer insists that they are still the executors of the estate which will be subject to inheritance tax. How can they assume this responsibility?

You need to get advice from another solicitor if you don't trust the existing one.
In Law special legal rules apply in intestacy for appointing an administrator to deal with the deceased persons affairs.
My wife died intestate a few months back, but as the next of kin it was automatically left to me to sort out.
